On confectionery packaging, manufacturers must also indicate the number of individually wrapped sweets – for example, wrapped candies. This was decided by the Federal Administrative Court (BVG) in Leipzig on March 9, 2023.
The BVG rejected the appeal of the confectionery company August Storck AG against a ruling of the Rhineland-Palatinate Higher Administrative Court in Koblenz. The State Office for Metrology and Verification had initiated administrative offence proceedings against the confectionery manufacturer. The authority criticized the fact that only the net quantity was indicated on several products. However, the number of pieces on the outer packaging was missing. The packages were those containing several individually wrapped sweets.
The confectionery producer had defended itself against the infringement proceedings with its lawsuit. The company wanted the court to declare that it did not violate the EU Food Information Regulation by not additionally indicatinge the number of individually wrapped products on the packaging. However, it was unsuccessful even in the first instance at the Koblenz Administrative Court.
